For example, since the June 2022 roll-out of the National Emphasis Program (NEP) on Heat-Related Hazards, current clients shared that they are seeing a rising number of visits from OSHA.

These visits are under the guise of compliance outreach efforts, i.e wanting to check their proactive program. For those unfamiliar, the NEP on Heat-Related Hazards requires Employers in 70 identified industries, construction and non-construction workplaces, to have outdoor and indoor prevention of Heat-Related Illnesses, training on signs and symptoms, and worker acclimatization schedules, amongst other items.

We see more and more of these OSHA ‘outreach visits’ are elevating to comprehensive inspections. There is also an increase in other federal agency visits or audits.

Most recently, we have been engaged to assist clients during Department of Labor (DOL) Wage & Hour audits and DHS/IER I-9 compliance audits, as well as workplace investigations for post-accident situations and allegations of Discrimination, Pay Inequities, Harassment (including Sexual), etc.

Employment laws are continually updated and OSHA’s penalties have increased 7.7% over 2022’s.

We believe given the Upcoming DOL Overtime Change that more planned and unplanned inspections will occur. Businesses of all sizes have much less time to ensure they have the up-to-date specific knowledge, tools, or resources to identify potential business and financial risks associated with regulatory compliance (i.e., OSHA, FLSA, EEOC, DOL, ADA, etc.).
